1. Who we are

Shotzy Pic ("Shotzy Pic", "we", "us") is operated by Shotzy Pic, a company based in California, USA. Shotzy Pic connects people who want photos taken ("customers") with independent photographers ("photographers"). These Terms apply to shotzypic.com and our apps.

2. Your account

You must be at least 18 to create an account. Keep your login details safe and tell us if you think someone else is using your account. You're responsible for activity on your account.

You must give accurate information. We may suspend or close accounts that break these Terms, put others at risk, or are used for fraud.

3. Photographers are independent

Photographers are independent and are not our employees. They choose when to go online, which requests to accept and what to charge. Photographers must complete ID verification before accepting bookings, and must follow all laws that apply to them, including taxes on their earnings.

4. Bookings and pricing

Each photographer sets their own prices. Before you book, you see the total for a photo bundle, a time package, or a custom session. Time packages can be extended in 15-minute steps, and each extension is charged to your saved payment method when you tap to add time.

5. Payments, fees and tips

Payments are processed by Stripe. When a photographer accepts, you pay the booking total. We hold the payment until you approve your photos, then release the photographer's share. We keep a 15% platform fee from each booking. Tips are optional, and 100% of a tip goes to the photographer with no platform fee.

If you save a payment method, you authorize us to charge it for bookings, time extensions and tips you confirm in the app.

6. Cancellations, no-shows and refunds

Customers can cancel a request before the shoot starts. If you've already paid, you get a full refund. A photographer may also cancel before the shoot starts, and any payment is then fully refunded.

If a photographer marks that they've arrived and you can't find each other within 10 minutes, you may end the booking for a full refund. Once a shoot has started, payments are not refundable except where required by law or where we decide, at our discretion, that a refund is fair. Tips can't be added to cancelled or no-show bookings.

7. Photos and video: ownership and usage

Customers receive a license to download, keep, share and use the photos and videos from their booking for personal, non-commercial purposes. Before payment, you may only see watermarked previews.

Photographers keep copyright in their work unless agreed otherwise in writing, and grant the customer the license above. Photographers may not sell or publish photos of customers without the customer's permission. A photographer's own portfolio shots, taken with the Shotzy Pic camera, may appear on their public profile. Customer albums are only public if the customer chooses to share them.

You give us a limited license to store, process and display content in the app so we can provide the service.

8. Location sharing

During an active booking, the app shares your live location with the other person on that booking so you can find each other. Location sharing stops when the booking ends.

9. Community Guidelines

You must agree to our Community Guidelines (shotzypic.com/guidelines) when you sign up and when you book. No nudity or sexual content. No inappropriate or explicit requests. No photographing minors unless their parent or guardian is present. No filming people who haven't agreed. No harassment. No illegal activity.

Photographers may decline any request, or end any session, that breaks these rules. Any payment is then refunded and the booking is reviewed. Anyone can report a booking, chat or profile. We may warn, suspend or permanently ban accounts that break the rules. Banned users can't sign in or create new bookings.

10. Acceptable use

Don't use Shotzy Pic to harass anyone, take photos without consent, upload content that isn't yours, get around our fees by paying off the app, or break the law. Photos and videos must be taken with the in-app camera.

11. Deleting your account

You can delete your account at any time from your dashboard. Open bookings are cancelled and refunded, but deletion is blocked while a shoot is in progress or a payment is waiting for approval. Any unpaid wallet balance is forfeited when you delete your account. We keep limited, anonymized records where the law requires (for example, payment records for accounting).

12. Disclaimers and liability

Shotzy Pic is provided "as is". To the fullest extent allowed by law, we're not liable for indirect or consequential losses, or for the acts of customers or photographers. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. [To be reviewed by counsel.]

13. Changes and contact
